When to Use a Notice of Sale Form
Not all mortgaged properties can give a Notice of Sale to the buyer. You may submit a Notice of Sale if:
- The property is not given to the owner due to a “Transfer on Death”
- The property is not sold by a dealer
- The property is not transferred to a beneficiary named in a trust.
If the tenant did not respond to the Notice of Sale the seller gave to him, the seller may file a lawsuit and upgrade the case to the court. When an auction is finalized to the calendar, the tenant will be given a 30 Day Notice Form or a Notice to Vacate Form to let him know that he is evicted from that property.
